The general terms and conditions of sale apply exclusively to current and future commercial relations between La boîte à thé.com and its customers. The purpose of these general terms and conditions of sale is to specify the buyer’s rights and obligations with regard to the products sold on www.la-boite-a-the.com. In the event of an actual order, the contract is governed by distance selling regulations and is subject to French law. Article 2: Products

Products may be added to or removed from the www.la-boite-a-the.com website without notice. The photographs presenting the products offered on www.la-boite-a-the.com are subject to slight variations in color due to studio lighting, and are therefore not contractually binding. Furthermore, La boîte à thé.com cannot be held responsible for any unintentional errors that may be contained in its offers. The items offered comply with current French legislation. La boîte à thé.com cannot be held responsible in the event of non-compliance with the legislation of the country where the items are delivered (censorship, prohibition of a title or author). It is the responsibility of the purchaser or recipient of the products to check with the local authorities whether the products may be imported or used. La boîte à thé.com cannot be held responsible for any accident or damage that may occur in the use of the items sold.

Article 3: Ordering

We undertake to accept your order in accordance with these terms and conditions. Please note that we will respond to your order while stocks last. If, in spite of our vigilance, the products prove to be unavailable (out of stock,…) after your order, we will propose to you by email a waiting period of 10 working days maximum for the manufacture of these, or will refund you if such is your wish.
By confirming your order, you accept all of these general terms and conditions of sale made available to you on the site, and acknowledge that you are fully aware of them, thereby waiving the right to rely on any contradictory document, and in particular your own general terms and conditions of purchase, as the act of purchasing implies acceptance of these general terms and conditions of sale. This confirmation and all data recorded by us shall constitute proof of our transactions.

Article 4: Prices

Prices are quoted in euros and include all taxes, but exclude shipping and handling costs, as well as any customs duties. We reserve the right to modify our prices at any time, but we undertake to apply the prices indicated at the time of your order.

Article 5: Payment

The price is due immediately on the date of the order. Payments are to be made by credit card using the 256 SSL secure encryption system of Paypal, Apple Pay or Google Pay.

Article 6: Delivery, shipping costs and delivery times

Unless otherwise agreed, delivery is made to the address you gave when you placed your order. Only deliveries with tracking and signature are guaranteed. Otherwise, we cannot be held responsible for any problems arising during delivery. No claims will be accepted. Postage and packing: A mandatory contribution to postage and packing is required. This depends on the number of items purchased and the country of delivery. You will be notified of this charge before confirming your order. You can find details of these charges in our “Help – FAQ” section. Delivery times: delivery may vary from 2 to 10 working days from the time your order is confirmed, depending on the availability of products in stock and the destination of your parcel.
As these times are given as an indication, exceeding them may not give rise to any cancellation of the order, any reduction in the price paid by the purchaser, or any payment by way of damages, as long as the customer is delivered within 30 days of receipt of the order.

Article 7: Right of withdrawal

The purchaser has the right to notify the seller that he/she renounces the purchase, without penalty and without giving any reason, within 14 working days from the day following the delivery of the product or the conclusion of the service contract. At the end of this 14-day period, the products delivered shall be deemed to conform to the purchaser’s order and to have been accepted by the latter.
An item may be reimbursed if it is returned undamaged within 14 days in its original packaging. In this case, the buyer is responsible for return shipping costs.
If you return an item due to an error on our part, you will receive a full refund of shipping costs. All complaints must be sent to the address mentioned in article 1. In the case of a personalized order (tea in a decorated box), as these are made-to-measure products, no right of withdrawal will be accepted from the moment the order is validated.

Article 8: Reservation of ownership

The delivered goods remain our property until you have fulfilled all your obligations towards us, and in particular until the price has been paid in full.

Article 9: Protection of personal data

You have the right to access and rectify information concerning you. To exercise this right, simply send an e-mail from the contact section or write to the address given in article 1. Under no circumstances will we pass on your confidential information.

Article 10: Intellectual property

All texts, visuals, photographs and graphics on the www.la-boite-a-the.com website are protected by copyright worldwide. As such, and in accordance with the provisions of the French Intellectual Property Code, only private and free representations made exclusively within a family circle and copies or reproductions strictly reserved for the private use of the copier and not intended for collective use are authorized. In the absence of prior written authorization from La boîte à thé.com, any other use constitutes an infringement and is punishable under the French Intellectual Property Code.

Article 11: Applicable law and jurisdiction

These terms and conditions of sale are governed by French law. All disputes relating to the commercial relationship between La boîte à thé.com and its customers are subject to the exclusive jurisdiction of the French courts. In the event of litigation, jurisdiction is attributed to the competent courts of Grasse, notwithstanding multiple defendants or the introduction of third parties.
